Pankina judgments,
applicants under the points-based system whose
applications were refused solely because they did not
meet the maintenance (funds) requirement can now request
UKBA to review its decision
The UK Border Agency has published revised policy
guidance for applicants under the points-based system
whose applications were refused solely because they did
not meet the maintenance (funds) requirement. If they
made their application within a certain time period,
they can ask UKBA to review its decision to refuse their
application.
If you have previously requested a review of UKBA
decision, but were refused solely because you did not
have valid permission to stay in the UK when you
requested the review, UKBA will automatically review the
decision. If you have not received an updated decision
by 31 January 2011, you should contact the address given
in the revised policy guidance.
